1. Subject These Terms of Use (GTU) are intended to define the terms and conditions for using the photeira.com website (hereinafter "the Service"), as well as its related services. By accessing the Service or using its services, you unconditionally accept these GTU. If you do not accept these terms, you must immediately stop all use.

2. Access to the Service and use of the services The Service is accessible to any person who is at least 18 years old. Access to the Service requires the creation of a personal account. The user (hereinafter "the user") agrees to provide accurate and up-to-date information when registering and to maintain the confidentiality of their password.

3. Terms of Use

   When accessing the Service, the user agrees to:

   • Be of legal age and have full legal capacity
   • Provide accurate registration information and update it in case of changes
   • Use the Service in accordance with applicable laws and regulations
   • Not create multiple accounts for fraudulent purposes
   • Verify the legality and compliance of the submitted and generated images, especially for commercial use

4. Usage restrictions

   The User agrees not to:

   • Use automated means (robots, scripts, etc.) to interact with the Service.
   • Bypass security measures or access unauthorized dat
   • Use the Service for illegal, defamatory, or fraudulent purposes
   • Share or resell their subscription without authorization
   • Reproduce, copy, or redistribute the Service’s content without written permission from Photeira.com (contact@photeira.com).
   • Edit with AI any photos that allow identification of physical persons.

5. User's Responsibility

   The user is solely responsible for the images they submit and the generated content. They undertake not to infringe upon the copyrights, image rights, or trademarks of third parties. Photeira.com cannot be held liable for the use of the generated content, including in cases of commercial or public distribution.

6. Intellectual Property

   The content of the Service (source codes, texts, graphics, videos, trademarks, etc.) is the exclusive property of Photeira.com. Any reproduction or use without written permission is prohibited.

   The images and videos created by the user on the Service belong exclusively to them. They guarantee that they have the necessary rights to the files submitted.

   The user undertakes to refrain from the following:

   • Using the generated content to train other AI systems.
   • Attempting to access, copy, or alter Photeira.com’s algorithms.
   • Compromising the security or integrity of the system.

7. Storing user's data At the moment, we do not store any date/images/whatever data obtained from the User, on our servers, except some pieces of personal information like email, name, etc.

8. Conditions for participation in the free trial A free plan is offered to any new user. Photeira.com reserves the right to refuse this trial in the case of a temporary email address, multiple usage, or suspicious behavior.

9. No guarantee of success The services of Photeira.com are based on artificial intelligence models. The generated results may vary and are not guaranteed. The user acknowledges that the results may differ from their expectations and that there is no guarantee of success. After buying the credits we can make full refund if:

   • it's not later than 14 days since purchase
   • if the User didn't spend more than 10% of their credits.

10. Amendment of the General Terms and Conditions Photeira.com reserves the right to change these Terms and Conditions at any time. The changes take effect upon their publication on the Service. Continued use of the Service after the publication of the new Terms and Conditions constitutes acceptance of these changes.

11. Limitation of liability Photeira.com strives to ensure the availability and reliability of the Service, but cannot guarantee complete freedom from errors, interruptions, or outages. Under no circumstances can Photeira.com be held liable for direct or indirect damages arising from the use of the Service or the generated content, including in the case of data, profit, or operational losses.

12. Personal data The personal data collected is processed in accordance with the Service's privacy policy. They are used exclusively for account management, billing, and service improvement. The user has the right to access, rectify, and request to delete their data.

13. Applicable law and disputes These terms and conditions are governed by Canada law. All disputes shall be submitted to the competent courts at the registered office of Photeira.com, unless mandatory legal provisions state otherwise.
